Terms & Conditions of Competition ​

  1. This KIC promotional competition (“Competition”) is run by KIC SA Pty (“Promoter”) and is open to individuals who are citizens of South Africa or legal residents in South Africa during the period of the competition, with a valid ID or passport, aged 18 years and older.
  1. This excludes any participants that are directors, members, partners, employees, agents of or consultants of KIC SA and, their subsidiaries, holding companies, divisions and/or associated companies or of the advertising, promotion or sales agencies or any other person who directly or indirectly controls or is controlled by the Promoters, or their spouses, life partners, immediate family members or business partners.
  1. This competition is exclusive to the Republic of South Africa. Proof of South African citizenship and age will need to be provided in the form of either a valid South African identity document, driver’s license or passport.
  1. These Competition Rules and any related notifications will be published on https://kic.co.za/promotions/
  1. Participation by all entrants (“Participants”) constitutes acceptance of these Competition Rules.
  1. Competition Period: The Competition begins on 11 December 2023 and ends on 22 December 2023.
  1. Prize/s: The Prize consists of 3 prizes for a total value of R17 500.00 (seventeen thousand and five hundred Rand). Three winners will be selected at the end of the promotional period. Only 1 prize will be awarded per winner and no person may win more than once in this Competition. Product prize breakdown:
    • 7.1 Refrigerator model: KBF 635/2 BL value: R7 200.00
    • 7.2 Refrigerator model: KBF 525/2 ME value: R5 900.00
    • 7.3 Refrigerator model: KTF 518/2 WH value: R4 400.00
  1. Entry: To ensure a valid entry, Participants must:
    • Visit KIC’s INSTAGRAM page like the page, like and comment on the latest competition post and tag 3 people in their comment. They can share the competition post to their timeline  for an extra entry.
  1. Draw and draw date: The Prize winners (“Winners”) will be selected by random draw of those consumers who have completed all the steps outlined in point 9.
  1. Winner’s Notification: Winners will be announced on 11 January 2024 on TMS as well as on our Instagram page. The winners will be required to contact us via their Instagram account to claim their prize. We will also attempt the contact by sending a message and contact request to their Instagram account. Following three (3) unsuccessful attempts to make contact with a drawn winner(s) within a 72-hour period, the prize will be awarded to the next eligible entrant drawn. It is expected that an individual will enter using an Instagram profile that is owned by and registered to that individual. No person can use another person’s Instagram profile for competition entry purposes. This is to avoid fraud and possible litigation between the phone owner and the entrant.
  1. Prize Redemption: The Prize will be delivered to the Winners upon an agreed time. Further details will be provided directly to the Winners.
  2. Prizes are not transferrable and cannot be converted to cash nor exchangeable to an alternate prize.
  1. Winners will be requested to send a copy of their South African ID or passport for verification purposes.
  1. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoter and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  1. The Promoter may make media announcements / publications of the names /photographs of Winners and/or Participants however any Winner or Participant may expressly choose to decline this. Winners or Participants will not receive any payment or other remuneration and all publicity and other materials will be the sole property of the Promoter.
  1. The Promoter reserves the right to shorten, extend, suspend the time period of the Competition or terminate the Competition whenever it should choose so for technical, commercial, or operational reasons, or for reasons beyond its control or generally for any reason whatsoever within their sole discretion. The Competition, its prizes, and terms and conditions may be amended by the Promoter, at any time during the Competition, and will be applied and interpreted within their sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition and acknowledge that the Promoter will not compensate any individual for any reason, whatsoever, and they will have no recourse against the Promoter whatsoever.
  1. Except as provided for in the Consumer Protection Act No. 68 of 2008 South Africa, the judge’s decision on all matters arising out of the competition will be final and binding, and no correspondence will be entered into.
  1. The Promoter reserves the right to substitute the prizes for an alternative prize of equal or greater value should the prizes promoted not be available due to unforeseen circumstances.
  1. KIC SA will not be held liable for any entrant that provides incomplete or incorrect details and any technical glitches beyond its control. The Promoter may disqualify entries and/or refuse to award the Prize/s to Participant/s and/or Winner/s if the entry infringes the copyright or any other rights of any third party, there is suspicion of any irregularities or fraudulent activities. Any liability arising as a result of infringements will be that of the Participant and not the Promoter.
  1. Entries which are incomplete, unclear, submitted incorrectly or submitted after the last day of entry or have errors are invalid.
  1. The Promoter reserves the right to withhold prizes in the event that they reasonably believe, in their sole discretion, that the winner is not eligible to win, has contravened any of these terms and conditions, has acted in a manner that is not in the spirit of the Competition, their conduct can be reasonably interpreted as scamming or circumventing the rules of the Competition, acted fraudulently with regards to the Competition, if it would be unlawful to award the prize or if the winner fails to accept the prize after 2 (two) attempts for any reason whatsoever. In this instance, the winner will be disqualified and forfeit the prize. The Promoter’s’ decision shall be final and no correspondence will be entered into.
  2. The Promoter accepts no responsibility for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
  1. The Promoter will not be liable for technical, hardware, or software failures of any kind or for lost or unavailable network connections which may limit or prohibit a Participant’s ability to participate in the Competition.
  1. By entering the competition and/or accepting the prize, entrants and winners hereby indemnify the Promoter, the organisers, their directors, employees, agents, suppliers and contractors from and against any actions, claims and/or liability for injury, loss or damages of any kind resulting in whole or in part, directly, indirectly or consequentially from participation in the Competition, acceptance of the prize and/or participation (or non-participation) in a prize-related activity.
  1. By entering this Competition each Participant authorizes the Promoter and the organizers of the Competition to collect, store, process and use (not share) personal information for purposes of performing this Competition, communication and/or statistical purposes.
  1. The processing of the Personal Information will take place in accordance with the provisions of the Protection of Personal Information Act 14 of 2013 (“POPIA”) and any other applicable law, and for the purpose of giving effect to the Competition. The Participant has the right to request any corrections or deletions of their Personal Information.
  1. By participating in this Competition each Participant agrees to receive future marketing material from the Promoter. The Participant may elect to opt out of receiving marketing material or request the Promoter to delete their information by contacting the Promoter via the details provided on their website (kic.co.za).
  1. This Competition is in no way sponsored, endorsed or administered by, or associated with Instagram or Meta.
  1. The competition shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
